These Terms and Conditions (“Terms”) govern your use of the ArtAscent website and any Content you provide to ArtAscent. By using this website or submitting Content, you acknowledge that you have read and agree to these Terms.

Definitions

Services: The ArtAscent website, publications, archives, and related communications, including digital, print, and social media.

Content: Any material you provide, including images, text, and other creative works.

Submitted Work: Content provided to ArtAscent.

Selected Work: Submitted Work chosen for publication or display.

Applicant: Any individual who has submitted Content to ArtAscent, whether through past open calls or by invitation (including Legacy Issues).

Project status

ArtAscent has concluded its open call program.

These Terms continue to apply to all Content submitted during the period in which open calls were active, as well as to any Content submitted by invitation, including Legacy Issues.

ArtAscent may invite selected artists and writers to participate in curated publications (“Legacy Issues”) at its discretion.

Eligibility

Applicants must be at least 18 years of age.

Submission and representation

By submitting Content, you confirm that:

• You are the creator or have the rights to submit the Content.
• The Content does not infringe any third-party rights.
• No other party has conflicting rights to the Content.

ArtAscent reserves the right to accept or decline any submission.

Editing and publication

All Content may be edited for formatting, layout, or clarity, including minor cropping or adjustments.

ArtAscent aims to present work faithfully but does not guarantee exact reproduction.

Published materials may remain available indefinitely, including in archives.

Ownership and license

You retain ownership of your Content.

By submitting Content, you grant ArtAscent a non-exclusive, worldwide, royalty-free license to:

• Reproduce, publish, and distribute your work.
• Display your work publicly.
• Use your work for editorial, promotional, and marketing purposes.
• Include your work in print and digital publications.
• Maintain and distribute archival versions.

This license applies to all Submitted Work, whether selected or not where relevant to promotion.

This license is perpetual, irrevocable, and continues notwithstanding any future changes to ArtAscent’s operations or publishing status.

Attribution information provided with your submission, such as your name and website, may be used in connection with your Content as part of publication and promotion.

Archival availability

ArtAscent publications, exhibitions, and related materials may remain available indefinitely, including through archives and third-party distribution services.

Because publication and distribution rights are granted at the time of submission, requests to remove or withdraw Content from existing publications or archives will not be accommodated.

Name changes and corrections

ArtAscent recognizes that individuals may request updates to their personal information, such as a legal name change.

Where reasonable and feasible, ArtAscent may update an individual’s name in digital records or future displays. However:

• Previously published print and distributed materials cannot be altered.
• Archived materials may remain as originally published.
• Updates across all platforms, formats, or third-party services cannot be guaranteed.

Requests will be considered on a case-by-case basis.

Fees (historical and invited submissions)

Past submission fees applied to open calls as published at the time.

Any future invited participation in the Legacy Issue may involve different terms or fees, which will be communicated separately.

Limitation of liability

ArtAscent is not liable for:

• Technical issues, delays, or data loss.
• Errors or omissions in published materials.
• Third-party content or services.

Use of the Services is at your own risk.

Third-party content and links

ArtAscent may include links to third-party websites or content.

We are not responsible for third-party content, services, or interactions.

Project continuity

ArtAscent may modify, suspend, or conclude its publishing activities.

All rights and licenses granted under these Terms remain valid and enforceable with respect to previously submitted and published Content.

Governing law

These Terms are governed by the laws of Canada.
