ArtAscent values your interest and involvement in ArtAscent and the time you spend on our websites
These terms and conditions of use constitute an agreement between you (“Applicant”) and ArtAscent and Skybase Publishing Inc. (“we” or “our”). Please read this agreement (“Agreement”) in its entirety before you continue to use this website or upload any image or articles (“Content”). By using this website, you agree to be bound by the terms and conditions of this agreement. If you do not agree, discontinue using the site.
Definitions. “Services” includes the print and digital ArtAscent Art & Literature Journal publication, the ArtAscent website and social spaces, including but not limited to Facebook, Twitter, Pinterest, Instagram, email newsletters, and print and digital marketing materials. “Content” includes text, files, designs, images, photos, video, sounds, works of authorship, and other material. “Selected Work” includes Content that you submit to ArtAscent and that has been selected for publication. “Applicant” is anyone who applies to any ArtAscent call for entry, call for artist and call for writers or otherwise provides Content to ArtAscent.
The ArtAscent calls begin and end on the date posted on the ArtAscent website. Events posted without a time end at 12:00 midnight (EST) on the posted date. Any extension to the submission deadline will be posted on the ArtAscent website.
Who may enter calls
Applicants must be 18 or older. Calls are void where prohibited.
The application fees and work submission sizes, formats and quantity limits are as posted on the ArtAscent website on the call web pages. Application fees cover the examination of your application. The odds of your work being selected for publication are dependent on the quantity and quality of applicants, and the projected quantity of artists to be published as per the call details.
To apply, please visit www.artascent.com to locate the application form of interest and follow the directions provided to upload your work. Submissions are complete when the Applicant’s work has been successfully uploaded and the required payment is received.
Only online applications will be eligible. No print applications will be accepted.
By applying to a call, the Applicant represents, acknowledges, and warrants that the submitted Content is original work created solely by the Applicant, that the Content does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the Content.
Notification of selected artist and writer Applicants, and the featured Studio Spotlight(s) if applicable, is made within five weeks of the theme call deadline. Notification is delivered via the ArtAscent email newsletter. Selected Applicants do not receive individual emails or other notices announcing that they have been selected. Selected Applicants are also published on the ArtAscent website, Facebook page, Twitter page, Instagram page and Pinterest page. Studio Spotlight articles are also published in the ArtAscent magazine, and may or may not be published on the ArtAscent website, Facebook page, Twitter page, Instagram page and Pinterest page.
Submission acceptance and editing
Artistic, editorial and advertising submissions will be accepted at the discretion of ArtAscent. The magazine is printed at 8.25” x 10.75” at single page vertical orientation. The utmost care will be put in to organizing our layouts to convey every image with the intention of the artist, however, if alteration/cropping is necessary to fit or add to the aesthetic of the layout, then the magazine reserves the right to minimally alter the image as needed. All submissions are subject to editing, including but not limited to text editing, image orientation mirroring, and image cropping to fit the page. If your work is published, ArtAscent recommends that you review it and submit any concerns before buying prints. No warranties of any kind, specific or implied, are provided concerning the accuracy or timeliness of any published materials.
Ownership of submitted images and articles
The Applicant owns the Content. You represent and warrant that: (i) you own or otherwise have the right to grant the licenses set forth in this section for the Content that you provide to ArtAscent, post on our website or other online spaces, or provide for our print services to have them printed in a magazine, and (ii) your Content does not violate the privacy rights, publicity rights, copyright rights, or other rights of any person or entity.
In order for ArtAscent to be able to provide you with our Services, you hereby agree to provide us with the following licenses to use your Selected Work:
License to print your Selected Work. You hereby grant to ArtAscent a non-exclusive, worldwide and royalty-free license (a “License”) to reproduce and distribute your Selected Work for the purpose of printing publications and for any other related purpose that you authorize. You agree that ArtAscent reserves the right to maintain the electronic files for any Submitted Work to fulfill any further orders which may be placed for such publication and the Services, and to maintain an archival copy of the printed magazine.
The Applicant grants to ArtAscent a License to reproduce, distribute, publicly display, use, and otherwise make available throughout the world the Submitted Work, including in actions required for the delivery of calls, publication, announcements and marketing. Applicants agree that ArtAscent may feature their submitted work for display, marketing, promotions, and exhibition archives, including ArtAscent publications, directories, websites, and social spaces. We will credit each artist with their name, artwork title and media, website, photographer credit, and gallery if requested. We may feature submitted Themed Call images, framed, in the Investors Tips section with the artist’s name and website, independently of the general call selections.
You represent and warrant that you ARE the author of your Content (including your Selected Work) and, in any case, that you bear the full and ultimate responsibility for the publication and distribution of your Content (including your Selected Work).
It is ArtAscent’s policy to terminate membership privileges of any Applicant who infringes copyright upon prompt notification to ArtAscent by the copyright owner or the copyright owner’s legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Services or used in any publication in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of the location on the Service of the material that you claim is infringing; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Limitation of liability
By participating, Applicants agree to release, discharge, and hold harmless ArtAscent and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in calls or any call-related activities and the acceptance and use, misuse, or possession of any publication and promotion hereunder.
ArtAscent assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to call applications or application forms; or alteration of applications or application forms. The Organizers are not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to Applicants’ or any other persons’ computers related to or resulting from participation, uploading, or downloading of any materials related to any call.
ArtAscent is not responsible for late, lost, incomplete or misdirected applications. Applications are void if ArtAscent determines the entry to not be an original, or if the applications are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.
Applicants also agree (a) to be bound by these Terms; (b) that the decisions of the jury are final on all matters relating to the calls; and (c) if he/she is selected, that ArtAscent may use the selected artwork and each selected artist’s name, country, and website address in any publicity or advertising relating to the call or future promotions without compensation or approval (except where prohibited by law). In the event that the selected artist(s) of any call is/are ineligible or refuses the publication and promotion opportunity, the publication and promotion opportunity will be forfeited and ArtAscent, in their sole discretion, may choose whether to award the publication and promotion opportunity to another Applicant. Publication and promotion of selected artist has no cash value.
Calls are void where prohibited. Calls may subject to country, federal, state, and local laws and regulations and certain restrictions may apply. All federal, state, local taxes, fees and surcharges on publication and promotion are the sole responsibility of the Applicant.
Third Parties and Other Users
Content from other Users, advertisers, and other third parties is made available to you through the Services. Because ArtAscent does not control such Content, you agree that ArtAscent is not responsible for any such Content, including advertising and information about third party products or services. Because ArtAscent does not have control over such Content, ArtAscent makes no guarantees about the accuracy, currency, suitability, or quality of such Content, and ArtAscent assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful Content made available by other Users, advertisers and third parties.
Your interactions with other Users or third parties, or with advertisers, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other User, the advertiser, or third party. The foregoing also applies to any interaction between Members (including the contribution and/or receipt of any Content) in the course of using the Services’ functionality. You agree that ArtAscent will not be responsible for any loss or damage incurred as the result of any such interactions and dealings listed in this section or with respect to any other User’s use or disclosure of your personally identifiable information.
